BEWARE! Generally amazon are very good BUT when things go wrong they seem to hide. I ordered a BLACK Nokia 2760 phone and received a grey/silver Nokia phone with a black facia and french instruction book. Apparently, the seller is not Amazon but Pixmania and they are proving to be extremely unhelpful. They and Amazon claim the goods are correctly described and a person at Pixmania informs me that their photographs are not contractual. OK, to be contractual in one sense may require supply of the actual goods in the photograph; clearly, this interpretation would be unreasonable with large volume sales but, surely, the goods have to look like the goods in the photograph in order to avoid Misrepresentation allegations. This case seems analagous to ordering a black pair of shoes online and clicking on the appropriate photograph of black shoes to complete the order and then receiving a grey/silver pair of shoes with a trace of black or, perhaps, black shoe laces. Would this be acceptable?
Amazon & Pixmania appear to be unable to see any problem with this situation. It seems that if you ordered shoes and received shoes then there is no problem. So the moral of the story is BEWARE!
