Kelkoo CashBack Service - Terms of Service

These Kelkoo CashBack Service terms are provided in addition to Kelkoo's general terms of service located at http://www.kelkoo.co.uk/co_16733-terms-of-use-kelkoo-uk.html

  • You represent that you are at least 18 years of age. You represent and warrant that you are either the owner or an authorised user of the computer on which you are installing the Software. You agree that you shall at all times comply with all local, state, national, and international, statutes, rules, regulations, ordinances and the like applicable to use of the Software.

  • Access to the Kelkoo Cashback Service is free, upon completion of a simple registration process located on the Kelkoo Cashback site accessible here http://cashback.kelkoo.co.uk.

  • You accept that your use of the Kelkoo Cashback Service, and any goods purchased or services received as part of this service, are purchased or received at your own risk and that the Kelkoo Cashback Service is provided "as is" and "such as available".

  • Upon successfully registering with the Kelkoo Cashback Service, you will receive a "welcome gift", for a limited time only, of £3. This sum will be credited to your Kelkoo Cashback account and will be valid until 31st March 2009. If, by this date you do not reach the necessary threshold of £12 worth of Discounts in your Kelkoo Cashback account, this welcome offer will no longer be valid and will no longer appear in your account. This welcome gift is available only once upon registration, is personal to you, is non-transferable and is limited to registered users of the Kelkoo Cashback Service.

  • In order for any purchases made on an affiliated Kelkoo Cashback retailer's site to be deemed "qualifying purchases", and therefore be subject to earn a Discount, you must have: (i) enabled "Cookies", both first and third party (if applicable) on your web browser, and (ii) begun your purchase by clicking on the affiliated retailer's link that appears on the Kelkoo Cashback site and successfully connect to the affiliated retailer's website from that click. Kelkoo may, at any time, route your request for an affiliated retailer site through specific links, in order to assure that the sale can be tracked correctly. You can also download and use the "Kelkoo Toolbar" software which will enable you to directly carry out your purchases on the site of the affiliated retailer and still earn the Discount. The determination of whether a purchase made through an affiliated retailer is a "qualifying purchase" is made at the sole discretion of Kelkoo.

  • The following purchases are not eligible for accrual or payment of Discounts: (1) purchases carried out other than wholly by Internet (e.g. if the purchase is completed by telephone or with a retailer's salesperson); (2) gift certificates, cards or vouchers that are purchased for use at any of our affiliated retailers are not eligible for a discount; and (3) any purchases that may be specifically indicated by the affiliated retailers on a list available from time to time on the Kelkoo Cashback site. This list may not be exhaustive and may be added to by Kelkoo at any time.

  • Discounts awarded to registered users are subject to adjustments for returns, cancellations, and other events. Kelkoo may apply such adjustments to registered users accounts at any time at its sole discretion. Should you disagree with any adjustments made to your account, your sole remedy is to withdraw from the Kelkoo Cashback Service.

  • Accumulated Discounts will ordinarily be credited on your account within 48 hours from the date indicated on the receipt for payment. However, it may occasionally take up to thirty (30) days for such Discounts to be credited.

  • It is your responsibility to check your account regularly to ensure that Discounts have been properly credited and that your account balance is accurate. If you do not believe that a Discount has been correctly credited to your account you must wait at least thirty (30) days but no more than ninety (90) days after completing the relevant qualifying purchase to contact our Customer Service as provided on the site. Furthermore, all Discounts earned by registered users are subject to review. Kelkoo may apply necessary adjustments to registered users' accounts at any time. If you do not agree to adjustments made to your account, your only recourse will be to discontinue use of the Kelkoo Cashback Service. Kelkoo reserves the right to terminate any account for abusive or fraudulent activity, or if the registered user is no longer contactable at the e-mail address provided.

  • For all Discounts credited to your account during any given month ("Month X"), a cheque will be sent to you at the end of the Month X plus 2 months, so long as the accumulated amount of the Discounts exceeds £12 in Month X. For example, if two Discounts of £9 and £4 are credited on your account between 1 January and on 31 January, a cheque for £16 will be sent to you by end of April (this example includes the £3 welcome gift payable if you reach the monthly threshold of £12 worth of Discounts).

  • If your account has not reached the qualifying threshold of £12 during any given month, then no Discounts will be payable. You are solely responsible for keeping all information on your registered user profile up to date, in particular your postal address, so as to facilitate the payment of such Discounts. If your information is not up to date at the time of payment, you may as a result lose the benefit of any accumulated Discounts. You can monitor and/or update your account and your profile at any time.

  • Affiliated Retailers operate independently of, and are not under the control of, Kelkoo in any way. Kelkoo may provide an index page or other description on our website of certain affiliated retailers' terms, which is provided for convenience only. Affiliates may impose conditions or restrictions different from, or in addition to, those described on such index pages or in such descriptions. Kelkoo is not responsible for changes to, or discontinuance of, any affiliated retailer or any affiliated retailer withdrawal from the Kelkoo Cashback Service or for any reduction of discounts made by us as a result of such changes, discontinuance or withdrawal or for non-payment of a discount by a retailer. Kelkoo is not responsible for changes to, or discontinuance of, any special offer or voucher code at an affiliated retailer site. It is your sole responsibility to make sure that all special offers are valid. If you choose to use vouchers and special offers that are not listed on the Kelkoo Cashback site, we cannot guarantee that you will be eligible to receive a discount on your purchases.

  • You understand that Kelkoo does not operate or control the products or services offered by third parties, promotional partners or participating affiliates. Third-party websites and online retailers accessed through the Kelkoo Cashback Service are responsible for all aspects of order processing, order fulfillment, delivery and handling, billing and customer service. Kelkoo is not a party to the transactions entered into between you and the retailers with which you choose to do business. If you buy products or services from affiliates you become a customer of those retailers and therefore must direct any comments, complaints or enquiries regarding your purchases to those retailers, and not to Kelkoo. All rules, policies (including privacy policies) and operating procedures of those retailers will apply to you while you are using those retailers' websites or local store locations. No reference or link to a third party product or service indicates an endorsement or recommendation by Kelkoo.

  • Kelkoo may modify these Kelkoo Cashback Service terms from time to time, by displaying the changes on the website or by email, and your continued participation in the Kelkoo Cashback Service after such modification shall be deemed to be your acceptance of any such modification. It is your responsibility to check the Kelkoo Cashback site regularly to see whether these terms have been modified. If you do not agree to any modification of these Kelkoo Cashback Service terms, you should immediately cease participation in the Kelkoo Cashback Service.
